In the lead-up to the attack on the United States Capitol in 2021, Biggs and other significant figures of the Proud Boys organization employed Parler to encourage their followers, urging them to disguise themselves as Antifa on January 6th.

In one of his messages, Biggs said, “We will emit an odor akin to yours, move as you move, and look like you do. The only thing that sets us apart is our thinking!” Additionally, he proclaimed that “Jan 6th is gonna be epic.”

On the day of the attack, Biggs and the Proud Boys leader Ethan Nordean led a group of Proud Boys members and supporters as they marched near the Capitol. Biggs utilized a walkie-talkie to give instructions, while Nordean used a bullhorn to communicate with the crowd.

A Proud Boys livestreamer characterized the duo as “Two men on a mission, with about 500 behind them ready to kick some butt for the benefit of this country.”

Together with Nordean and other Proud Boys members, Biggs entered the Capitol building, where he was captured on various video recordings and photographs. In one video, someone called out Biggs’ name, and he replied, “This is awesome!”

Biggs was apprehended in 2021 on charges arising from his involvement in the Capitol attack. Nordean and three other Proud Boys leaders were also charged.

The charges against Biggs include “conspiracy, obstructing an official proceeding, obstruction of law enforcement during civil disorder, destruction of government property, entering and remaining in a restricted building, and disorderly conduct in a restricted building.”

The March 2021 indictment filed by federal prosecutors accused the four Proud Boys leaders of taking part in the planning, preparation, and execution of the insurrection, which included raising funds for the Proud Boys to travel to Washington, obtaining paramilitary and tactical gear and supplies, and employing radio and encrypted messaging apps to coordinate the siege of the Capitol.

The indictment asserts that the four Proud Boys leaders were among the first to forcefully breach the police lines and enter the Capitol, together with the Oath Keepers.

Initially, Biggs was granted pretrial release on the condition of home confinement, but his bail (along with Nordean’s) was revoked after more severe charges were brought against them and new evidence emerged regarding their leading role in planning the attack on the Capitol.

In ordering the revocation of their bail, Judge Timothy J. Kelly stated, “The defendants stand charged with seeking to steal one of the crown jewels of our country, in a sense, by interfering with the peaceful transfer of power.

It’s no exaggeration to say the rule of law and… in the end, the existence of our constitutional republic is threatened by it.” Biggs is currently being held at the Seminole County Jail with some other federal pretrial detainees.
